把調解引入多方平台

font-size: 12pt; font-family: Arial; background: #ffffff;">在學聯與政府官員的會面中,林鄭月娥司長提出成立一個討論政改的多方平台,讓社會各界,包括學生和年輕人,一起參與討論,但討論重點是2017後香港政制的長遠發展。不過,到現在為止,特區政府對這個多方平台應如何組成、如何開展討論、希望透過討論達成什麼成果,卻完全欠缺實質的內容。</span></p><p style="margin-top:0pt; background: #ffffff;">「十三學者方案」倡議人之一的宋恩榮教授之前建議特區政府應成立獨立委員會推動政改。他的建議是特區政府在第二階段政改諮詢開展之前,委任有廣泛認受性的社會人士,組成有公信力的獨立委員會,探討在人大政改憲制規範下提高民主參與的可行方案,以滿足香港市民對民主的訴求。委員會主席應由德高望重的社會人士(如前大法官李國能)擔任,成員則可包括學生及有廣泛認受性的社會人士。</span></p><p style="margin-top:0pt; background: #ffffff;">宋教授認為多方平台因着重代表性,要包括泛民、建制、學生及佔中人士各方勢力,人數眾多且意見南轅北轍,故只能是個務虛的「口水會」,難以在短期達成共識。他所倡議的獨立委員會卻是務實的,其工作是探索具體可行的政改方案,以便政府明年初向立法會提交政改法案,以完成「政改五部曲」的第三步。</span></p><p style="margin-top:0pt; margin-bottom:0pt; text-autospace:ideograph-numeric; text-autospace:ideograph-other; layout-grid-mode:char; vertical-align:; "><span style="letter-spacing: 0pt; font-size: 12pt; font-family: Arial; background: #ffffff;">同是「十三學者方案」倡議人之一的王于漸教授也有相近的建議,認為特區政府要建構由第三方主持的議價平台,設立由社會上德高望重人士組成的委員會,就政改的大方向草擬建議書呈交政府,內容要符合憲制規範,並充分反映市民大眾不同的政治訴求,建議書將公開。在展開「政改五部曲」下一階段之前,委員會應完成有關任務。王教授認為這委員會雖然任重難當,卻可以具備獲各方面以及中央政府信任的優點,有助爭議各方重建互信。</span></p><p style="margin-top:0pt; background: #ffffff;">最近我亦收到一位國際級有關公共紛爭調解的專家學者給我解決現在香港困局的的建議。他提議兩傘運動一方及特區政府可以共同商討一名或多名大家都能接受、具備調解經驗的人士為調解者或組成調解團隊,然後雙方可提交五至七名代表參與面對面的調解會議。調解者或團隊會在雙方會面前,先促成雙方就調解面談會處理的範圍及會面的時間表達成協議。他建議會面的時間表可以是二至三個星期。</span></p><p style="margin-top:0pt; background: #ffffff;">在會面期間,佔領行動會繼續。雨傘運動的代表在這階段毋須就退場作出任何承諾。調解面談的目的,是希望雙方達成最終的協議,能就一些中期的問題達成共識,並同意就一些長遠的問題設立一個監察及滙報的機制。</span></p><p style="margin-top:0pt; margin-bottom:0pt; padding:0pt 0pt 0pt 0pt ; layout-grid-mode:char; vertical-align:; "><span style="letter-spacing: 0pt; font-size: 12pt; font-family: Arial; background: #ffffff;">因加入了調解團隊,那就可避免面談淪為單純是各自表述的「口水會」。亦因為調解面談有清楚的時間表,故也不會令討論曠日持久。這建議是希望各方能一步一步先就一些技術問題達成協議,再進一步就一些中期的安排達成共識,並最終可以同意設立一個可處理分歧的長遠機制。</span></p><p style="margin-top:0pt; "><span style="letter-spacing: 0pt; font-size: 12pt; font-family: Arial; background: #ffffff;">公民抗命就是為了要令各方看重公民抗命者提出來的公義訴求,以促使各方能為紛爭的解決方法達成共識。公民抗命的本質其實就是要在公義的標準下化解紛爭。</span></p>
