letter-spacing: 0pt; font-size: 12pt;">」,認為香港特區</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">之自治</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">範圍,只包括地面和海域,並不包括地底</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">所以</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">北京只要</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">把高鐵總站地底</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">劃</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">為大陸邊防區,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">就可落實一地兩檢</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">胡漢清「地底論」</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">一出,迅即</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">飽受各界</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">批評。有網民笑言,假如</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">「地底論」</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">成立,以後乘地鐵也要回鄉證,死後土葬就是「客葬異鄉」。其實胡漢清的</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">「地底論」</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">不單有違常理,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">實際上也</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">可能違反大陸對地方行政區域劃界的</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">現行規範</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。根據</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">中華人民共和國</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">《行政區域界線管理條例》第五條,「行政區域界線的實地位置,以界樁以及作為行政區域界線標志的河流、溝渠、道路等線狀地物和行政區域界線協議書中明確規定作為指示行政區域界線走向的其他標志物標定」</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">這表示北京對地方</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">區域</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">邊界</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">之</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">劃分</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">主要以地面界線為準,並無地底邊界</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">的</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">說</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">法</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">例如前年北京把澳門關閘邊檢大樓列入特區範圍時,亦以地面界樁標示澳門和廣東省的新邊界。而地底地面分由不同行政區執法的情況,更加</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">聞所未聞</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。以橫跨廣東和湖南的九嶷山隧道為例,位於廣東的南段,由廣東公安管轄,位於湖南的北段,則由湖南公安管理。如果連實行「一國一制」的廣東省也不容省外人員管理地下設施,實施「一國兩制」和《基本法》的香港</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,就</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">更沒理由交出高鐵站地底的管理權。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">既然劃出車站地底給大陸的建議不可行,有些人便提出把車站部份土地,連同高鐵管道途經範圍,一併劃入大陸範圍。按全國人大的規定,港澳特區的行政區域可由國務院單方面更改,毋須特區政府同意。北京就曾運作此權擴展澳門特區的邊界</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,但此</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">方案衍生的問題可能更大。首先,把原屬特區的土地劃給大陸,將令人憂心定下壞先例,難保日後北京又會以別的理由</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">劃走其他香港土地。更大的問題是高鐵管道,既然「地底管轄權」一說站不住腳,當地底管道被劃入大陸,地面土地亦須照辦,由於高鐵走線深入市區,大陸管轄的土地將會把香港劏成兩半,對香港未來發展構成深遠影響。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">環顧世界的跨境基建,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">新加坡</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">亦</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">曾被類似問題困擾</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">當新加坡1965年從馬來西亞獨立時,雙方協定大馬可以維持對新馬鐵路,和位於新加坡市區之丹戎巴葛火車總站(實施一地兩檢)的主權。但新加坡漸漸發現,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">鐵路用地</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">對城市發展構成嚴重阻礙,所以與大馬商討解決方案,經過漫長談判,新加坡到了2011年才透過與大馬換地,取回鐵路範圍,並把車站遷往新馬邊境。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">一地兩檢遲遲未</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">解</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">決,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">因為在</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">異常複雜</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">之法律問題背後,實際上關乎香港之邊境管轄權;而中港邊界之區隔,則是香港自治地位之象徵</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">。</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">假如我們無法守護好邊境管轄權,一地兩檢將成為香港自治崩塌之新缺口。</span></p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"> </p><p style="margin-right: 0pt; margin-bottom: 0pt; margin-left: 0pt;"><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">此間不少建制人士,如胡漢清等,經常按耐不住,提出一些違反常理,並很可能影響特區自治和長遠發展的「解決方案」。</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">香港人</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">必需提高警覺,及時</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">予以駁斥</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">,</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">否則隨時</span><span style="font-family: Arial; letter-spacing: 0pt; font-size: 12pt;">恨錯難返。</span></p><p style="margin-right: 0pt;
